Real Estate Services
TITLE OPINION LETTERS
Our attorneys regularly provide opinions as to real estate title. These letters may be used by lenders, municipalities, county commissions, companies, and corporations that are processing loans, changes in ownership, or replacing. We are experienced in title opinion letters for subdivisions, commercial properties, and individual homeowners.
NOTE AND MORTGAGE DRAFTING
Lenders may contact our office if your transaction requires that a note and/or mortgage be drafted for a closing on real property. Title insurance is available for lenders through our affiliate, Paulus Title, LLC. Please contact Paulus Title at 256-776-7704, for more information on our affiliate title company.
COMMERCIAL AND RESIDENTIAL TRANSACTIONS
We represent lenders, developers, builders, investors, and individuals in a variety of commercial and residential transactions. Our attorneys are also employees of Foundation Title and Escrow Series (AL), LLC, which provides settlement and title insurance services.
Our office can provide you with a will to direct your personal representative on how to distribute your assets. Wills also direct the probate court as to who should care for your minor children and how much of your estate your surviving spouse and surviving children should inherit. Without a will, a deceased person's assets are distributed according to the Alabama Intestacy Laws. Often, these distribution laws are not compliant with what the deceased would have desired.
POWER OF ATTORNEY
Often powers of attorney are used in real estate transactions if the principal is unable to attend closing. For powers of attorney to be used in a real estate transaction, they need to be approved by the title insurer and the lender providing financing on the transaction.
ADVANCE HEALTHCARE DIRECTIVES
Advise medical personnel and family members of a person's wishes if that person were to be medically incapacitated and on life giving support. Our office can assist you in deciding how to handle your affairs and medical decisions if you become incapacitated.
BUSINESS ENTITIES AND NON-PROFIT SERVICES
We guide our clients through the formation of new business entities. From simple corporations, single-member LLCs to complex limited partnerships and series LLCs, our attorneys have the experience to help our clients launch their new ventures.
We also help clients as they purchase and sell businesses or plan for succession to their children or business partners.
We also represent several non-profits, such as HOAs, churches, and charities.
We assist clients in the drafting and negotiation of contracts relating to new business ventures, the purchase, sale, and financing of businesses and assets. We also assist with a variety of other issues, such as employment, non-competition, and non-solicitation agreements, which can be essential to our clients’ businesses.
